- There is no forced arbitration. Texas law applies.
This summary is for convenience. The full Terms below are what apply.
1. Who we are and who may use Evallo
Evallo is a service owned and operated by WCM Legacy Group LLC, a Texas limited liability company (“Evallo,” “we,” “us,” or “our”). These Terms form an agreement between you and WCM Legacy Group LLC when you create an account or use the Service.
You must be at least 18 years old, able to enter into a binding contract, and located in the United States. Evallo is not currently offered to customers outside the United States. You may use Evallo only for your own lawful job search unless we agree in writing to another use.
2. Your account
You must provide accurate account information, keep your sign-in credentials confidential, and notify us promptly if you suspect unauthorized access. You are responsible for activity performed through your account except to the extent caused by Evallo’s failure to use reasonable safeguards.
One individual may not share a personal account with other people, resell access, or use automated means to create accounts or evade plan limits. We may require you to verify your identity before completing a sensitive request.
3. The Service
Evallo helps you organize opportunities, recruiter contacts, conversations, interviews, tasks, notes, and related job-search information. Available features depend on your plan and may include Basic Capture (organizing text you paste, directly in your browser and without AI), AI-assisted review, analytics, exports, or other tools described at the time of use.
We may improve, replace, limit, or discontinue features. If a change materially reduces a paid plan during its current paid period, we will provide reasonable notice and an appropriate remedy when required by law. Beta, pilot, preview, and “coming soon” features may change or be withdrawn and are not part of a paid commitment unless expressly included at purchase.
4. Your content and your responsibilities
You keep ownership of the information and materials you enter into Evallo (“Customer Content”). You give Evallo a limited, non-exclusive license to host, copy, process, transmit, display, and back up Customer Content only as reasonably necessary to provide, secure, maintain, support, and improve the Service, comply with law, and enforce these Terms. This license ends when the content is deleted from active systems, subject to legal retention needs and normal backup cycling.
You are responsible for Customer Content and must have the right to use it. Recruiter, interviewer, and contact details may concern other people. Do not upload Social Security numbers, financial-account details, health records, government identification numbers, passwords, or other sensitive information that is unnecessary for your job search. Do not use Evallo to secretly record people or violate privacy, employment, intellectual-property, or communications laws.
5. AI-assisted features
AI features may help extract details, summarize information, or suggest next steps. They can be incomplete, inaccurate, or misleading. AI output is not employment, legal, financial, tax, or professional advice. You must review dates, names, compensation, commitments, and other important details against the original source before relying on or saving them.
Evallo does not authorize AI to contact recruiters, submit applications, accept offers, or make material CRM changes without your review. AI access may be subject to per-period limits. Reaching a limit does not create an automatic overage charge; non-AI features that are included in your plan remain available.
6. Acceptable use
You may not:
- use the Service unlawfully, fraudulently, deceptively, or to harass, discriminate against, surveil, or harm another person;
- upload malware, probe for vulnerabilities without written permission, bypass access controls, or interfere with the Service or another account;
- scrape, bulk-extract, reverse engineer, copy, or create a competing service from non-public portions of Evallo except where law expressly permits;
- use Evallo to send spam, conduct automated outreach, impersonate another person, or make decisions that unlawfully affect another person;
- use content from another person without appropriate permission, or infringe intellectual-property, privacy, publicity, or contractual rights; or
- resell, sublicense, transfer, or commercially exploit a personal plan.
7. Plans, billing, cancellation, and Pay once access
Plan prices, renewals, trials, taxes, introductory pricing, cancellation, Hold, refunds, and payment disputes are governed by the Billing, Cancellation & Refund Policy. Any Pay once purchase is also governed by the Pay once Terms. Those policies are part of these Terms.
8. Third-party services
Evallo depends on third-party services for hosting, authentication, database storage, email, payments, security, and optional AI processing. Their services may be subject to separate terms and may occasionally be unavailable. Links to third-party sites do not mean Evallo controls or endorses their content. Our Privacy Policy explains how service providers process information for Evallo.
9. Evallo’s intellectual property
Evallo and its software, design, branding, documentation, and other materials are owned by Evallo or its licensors and are protected by law. Subject to these Terms, we give you a personal, limited, revocable, non-exclusive, non-transferable right to use the Service during the applicable access period.
If you voluntarily provide feedback, you allow us to use it without restriction or compensation, but we will not publicly identify you as its source without permission.
10. Suspension and termination
You may stop using Evallo at any time. Canceling a paid subscription, canceling your account, and deleting your account are separate actions.
Canceling a paid subscription stops renewals. You keep paid access through the paid period, and the account then moves to Starter. Your records stay saved, subject to Starter’s limits.
Canceling your account in Settings ends sign-in: right away if you’re not on a paid plan, or at the end of the paid period on a paid plan, which you can undo in Settings until then. We keep a canceled account’s records for 30 days after it closes, then delete them automatically. A closed account can’t be reopened.
Pay once doesn’t renew, so there’s no subscription to cancel. To close a Pay once account, ask us to delete it.
To delete your account and records sooner, email contact@getevallo.com.
We may suspend or terminate access if you materially violate these Terms, create a security or legal risk, fail to pay an amount due, or misuse the Service. When reasonable, we will provide notice and an opportunity to correct the problem. We may act immediately when needed to protect people, data, the Service, or comply with law.
11. No employment guarantee
Evallo is an organizational tool. We do not act as your employer, recruiter, career adviser, or agent. We do not control employers, job listings, interviews, hiring decisions, offers, background checks, or compensation. We do not promise that using Evallo will result in an interview, offer, employment, or any particular outcome.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not disclaim warranties or rights that cannot legally be excluded.
13. Limitation of liability
To the maximum extent permitted by law, Evallo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, opportunities, goodwill, or data, arising from the Service. Evallo’s total liability for all claims relating to the Service will not exceed the greater of (a) $100 or (b) the amount you paid Evallo during the 12 months before the event giving rise to the claim.
These limits do not apply where prohibited by law or to liability that cannot legally be limited. Some states do not allow certain exclusions, so some of this section may not apply to you.
14. Your responsibility for misuse
To the extent permitted by law, you are responsible for claims, losses, or costs resulting from your unlawful Customer Content, your material violation of these Terms, or your intentional misuse of the Service. We will provide prompt notice of a covered claim and allow reasonable participation in its defense.
15. Governing law and disputes
Texas law governs these Terms, without regard to conflict-of-law rules, except where your state’s consumer law requires otherwise. Before filing a lawsuit, you and Evallo agree to make a good-faith effort for 30 days to resolve the dispute by emailing contact@getevallo.com. If the dispute is not resolved, it may be brought in a court of competent jurisdiction in Texas, unless applicable law gives you the right to bring it elsewhere.
These Terms do not require binding arbitration and do not waive your right to take part in a class action. If we ever propose adding either, we will give you clear advance notice, and the change will not apply to a dispute that arose before it.
16. Changes to these Terms
We may update these Terms. We will post the updated version and effective date and provide reasonable advance notice of material changes that negatively affect paid customers. Changes apply prospectively unless law requires otherwise.
17. Notices and electronic communications
We may send notices about your account, these Terms, or the Service to the email address on your account or by posting them in the Service. You agree to receive these communications electronically, and they satisfy any requirement that a communication be in writing. Keep your account email current. You can send notices to us at contact@getevallo.com or by mail to the address below.
18. Copyright complaints
If you believe material available through Evallo infringes your copyright, email contact@getevallo.com with “Copyright complaint” in the subject line. Describe the work, identify where the material appears, include your contact information, and state that you believe in good faith the use is not authorized. We will review complete notices and respond.
19. General terms
These Terms, together with the policies they reference, are the entire agreement between you and us about the Service and replace any earlier agreement about it. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of internet or service providers, natural disasters, or government action.
Sections that by their nature should continue after your account ends continue to apply, including those on Customer Content, intellectual property, disclaimers, limitation of liability, your responsibility for misuse, and governing law.
If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms or your account without written permission. We may transfer these Terms as part of a reorganization, sale, or transfer of the Service, subject to the Privacy Policy and applicable law.
